Introduction

Who is ALZAVOLA

ALZAVOLA is the will of the Owner to reach the final consumer with a product entirely made in Italy . A short supply chain is guaranteed where the raw material is the same used for the big brands in the fashion world, but instead of asking for new raw material generating a deficit for the environment, already existing materials are used as much as possible without burdening the induced by cotton. This is a voluntary and conscious choice. After the purchase of raw materials, the entire supply chain is followed by competent and highly specialized staff and the product never leaves regional borders.

ALZAVOLA sells only new and original products. All the items available on our site are produced and managed by the Owner; respecting the European safety certifications for the production of women's, men's and children's clothing.

This document

This document constitutes a legal agreement between you, as a user, and the owner who manages ALZAVOLA. It governs your use of the website and, in any case, the use of the services provided. "Legal Agreement" means that the terms of this agreement, once accepted by the User, are binding for both parties.

Type of User

Registered user or guest

The User is free to register or not in order to use the service or part of it, but they must provide all the data requested in the purchase phase in a truthful and complete manner and fully accept the privacy policy and these general conditions. The User has the duty to guard and keep his access credentials confidential. It is understood that in no case can the Data Controller be held responsible in case of loss, your diffusion, theft or unauthorized use by third parties, for any reason whatsoever, of the Users' access credentials.

Using data

The personal data of the interested party will be processed for purposes strictly related to the purchase of the product. In particular:

  • management and execution of the contractual relationship and related obligations;
  • fulfillment of obligations established by laws, community legislation, and instructions prepared by the authorities and supervisory bodies.

The user's information relating to the order will be kept for the time necessary to provide assistance and support in the event of a return and / or solve any problem relating to the order and, in general, for management and execution of the contractual relationship and the related fulfillment of obligations established by law.

Delete user account

In case of direct request from Users through ALZAVOLA, or by contacting the Owner directly, it will be possible to deactivate the accounts, request their cancellation or stop using the service.

The Owner himself reserves the right to suspend or close the User's account at any time and without notice, when it deems that the User is violating or improperly exploiting the account.It also reserves the right to suspend or cancel the User's account at any time and without notice if it believes that:

  • the User has violated the Agreement; and / or
  • access or use of the Service could cause damage to the Owner, to other Users or to third parties; and / or
  • the use of ALZAVOLA by the User may result in a violation of the law or applicable regulations; and / or
  • in the event of investigations conducted as a result of legal actions or for the involvement of the public authority; and / or
  • the account is considered by the Owner, at its sole discretion and for any reason, inappropriate or offensive or in violation of the Agreement or not in line with the standards of the Owner

Purchase

Terms of sale

The selling price of the products is expressed in Euro (€) and inclusive of VAT. Any change in the VAT rate could immediately reflect on the price. The price displayed on the cart does not include handling and shipping costs; the total amount due is indicated on the order confirmation page before the final express forwarding of the order.

Purchase procedure.

The User must select the products, add them to the cart and complete the check-out, after carefully checking and possibly modifying the information contained in the order summary. The order is made by confirming the order and is subject to payment of the price, taxes and shipping and payment costs indicated in the Order Summary form. If not expressly indicated for the activation of some offers, the user is required to pay the transport costs.

The Order Processing Receipt does not constitute acceptance of the order. The conclusion of the contract takes place when the Order Confirmation is sent by the Owner to the email address provided by the User. The Owner reserves the right not to confirm an order, communicating to the User within 20 working days of placing the order, at the email address associated with his purchase, of any unavailability of one or more of the products purchased. In this case, the Owner will only reimburse the price and shipping costs incurred by the User.

Payments

Credit Card

For payment methods with PayPal and credit card, ALZAVOLA uses the payment system of the institution that manages the payment. Thanks to this system, ALZAVOLA does not display or save in any way the credit card details of their customers. ALZAVOLA reserves the right to request additional information from the customer or to send copies of documents proving ownership of the card used. If the customer does not provide such information, ALZAVOLA reserves the right not to accept the purchase order.

ALZAVOLA will ship the products only when the relative amount is credited to the current account indicated above, therefore processing and shipping times may be higher.

Payment security

Any type of payment on ALZAVOLA is risk-free. Your data will always travel on secure and encrypted servers.

Purchases on ALZAVOLA are completely protected.For payment by credit card we use the secure SSL system: upon confirmation of the order, the credit card data will be transferred to the card manager, via a secure SSL (Secure Socket Layer) encrypted connection, for authorization and debit. A safe and risk-free procedure that protects the customer from any possible abuse.

Offers and discounts

The Owner reserves the right, at its sole and unquestionable discretion, to offer discounts and / or offers for a limited period of time. The conditions to which these discounts and / or offers are subject are indicated from time to time on the relevant information page on ALZAVOLA. Each discount and / or offer will be valid until the set deadline or, if applicable, while stocks last. If the discount and / or offer are subject to time limits, the time indicated refers to the time zone of the Owner, as per the address indicated in this document.

Order management

Order status

Registered customers will be able to monitor the status of all orders by logging in and entering their reserved area, under my orders.

It is also possible to monitor the status of the shipment of orders, always entering your private area and selecting order tracking.

Order changes

We remind the customer that, once an order has been placed for the available items, it is possible to make changes to this order only until the order has been shipped, by contacting customer service at +39 3401615911 or by sending an email to customercare@alzavola.it.
The costs of the call depend on the telephone contract that the User has.

We remind you that after shipment it is not possible to make changes to the order sent. If you want to ship to multiple different addresses you need to place multiple orders.

If you want to add a new item to an order that has not yet been shipped, you can proceed with a new order by calling us directly at +39.340.161.5911.

Unless otherwise indicated and offers, shipping costs are € 10 for orders under € 300 and free for orders over € 300 and relate to a single order with a single destination. The order amount refers to the total actually paid after any deductions, offers or vouchers.

For cumulative orders the shipping costs are not canceled or modified, they remain unchanged according to the order placed.

Shipping and returns.

Shipping in Italy

For all orders in the province of Vicenza, delivery will be made directly and personally by the ALZAVOLA team. Sure of the Customer's understanding, if this service is chosen, delivery could be made 48 hours from payment in the morning (before 08:00) or in the evening (after 19:00). The customer can still choose the shipment by courier or express courier.

We want to offer this service to get to know the customer and convey our authenticity to him. We look forward to welcoming you.

Whenever the User so desires, we deliver expressly 24/48 h throughout Italy with express courier DHL or Bartolini. So for all credit card orders you buy today and receive tomorrow. For this service the customer is asked for a contribution of only € 5.

For simple transport, shipping costs are included and delivery times are 48 hours for northern and central Italy, 48/72 hours for southern Italy and the islands.

For orders by bank transfer, shipments will be made upon arrival of the bank transfer.

Only in the event that, for any reason, the shipment fails to be successfully delivered to the address provided by the Customer in the commercial contract, and the package returns to the sender or remains in storage, any shipping costs or stock will be charged to the Customer. These amounts will be deducted from any refund due to the Customer by ALZAVOLA.

ALZAVOLA assumes the responsibility to ship orders punctually and precisely, once the packages have been shipped the responsibility for delivery lies with the courier, ALZAVOLA does not take responsibility for any lost or undelivered packages, we will do everything possible to recover them but not will be refunded.

Immediate shipping

Orders are shipped by the Owner during working hours from Monday to Friday. Orders placed after 12.00 will be processed the following business day.

Orders for available products are shipped within 24 hours. Orders placed before 12.00 leave the same day.

Orders on Fridays after 12.00, Saturdays and Sundays and holidays will be processed on the first available working day.

Only on exceptional occasions, ALZAVOLA will be able to decide to process the order even on Saturdays or holidays at what time there is the possibility.

In all cases, ALZAVOLA reserves the right to postpone the shipment if the order cannot be shipped for reasons of force majeure, if a product is not available, ALZAVOLA will contact you to propose a replacement or refund. Please note that during the Christmas holidays there may be delays in shipping.

Delivery of the order

Upon arrival of the goods, customers are asked to carefully inspect the package before signing as proof of delivery of the shipment. If for any reason, the package appears to have been tampered with, customers are asked to sign the receipt with reservation, or to refuse delivery. In the event that the delivery has been accepted with an unauthorized signature or there is evidence of tampering with the package, customers are requested to immediately report the incident to ALZAVOLA at customercare@alzavola.it.

Only in the event that, for any reason, the shipment fails to be successfully delivered to the address provided by the Customer in the commercial contract, and the package returns to the sender or remains in storage, any shipping costs or stock will be charged to the Customer. These amounts will be deducted from any refund due to the Customer by ALZAVOLA.

Fulfillment of orders

Once an order has been placed for the items available, changes can be made to that order only if the order has not yet been shipped. ALZAVOLA reserves the right to postpone the shipment if the order cannot be shipped for reasons of force majeure. Please note that during the Christmas holidays or in the periods of national holidays or intense national promotions there may be delays in the shipment. It is at the sole discretion of ALZAVOLA the right to refuse an order and / or the provision of a service to anyone at any time.

Right of withdrawal of the order

In case of purchase of products or services on ALZAVOLA, the User has the right to withdraw from the contract without stating the reasons, within 30 days. The withdrawal period expires after 30 days from the day on which the User or a third party - other than the carrier and designated by the User - acquires physical possession of the goods. To exercise the right of withdrawal, the User is required to inform the Owner of the decision to withdraw by means of an explicit declaration sent to the indicated contacts.

Free order withdrawal

Exchanges or returns can be made within 30 days of the order date
The shipping method is by courier Bartolini indicating the freight collect.

The items to be returned must be sent in their original packaging, with their own tags, as they were received. The goods must not have been used, tampered with, washed, and must be returned with attached label and original packaging.

The refund can be made via a discount coupon with free shipping or by crediting the value of the returned products in cash.

If the customer decides to:

  • return the goods by requesting a refund in terms of discount coupon
  • return the goods asking for a refund in terms of exchange (see example 1)

then ALZAVOLA will not charge the customer any additional costs, unless there is a difference in the cost of the new product ordered.

CUSTOMER ORDER: € 300

REQUEST FOR REFUND BY EXCHANGE OF GOODS FOR A PRODUCT AT THE COST OF € 400.

NEW CUSTOMER CHARGE OF € 100.

The right of withdrawal is guaranteed by the Legislative Decree 22/05/1999 n. 185, relating to the protection of consumers in the field of distance contracts.

An essential condition for exercising the right of withdrawal is the return of INTACT products in their ORIGINAL PACKAGING.

Returns will not be accepted and refunds will not be issued for items which have not been requested through the procedure or which have not been notified by email (by sending photos) of any non-compliance or damage.

Free return under warranty

The consumer user has the right to a guarantee on the conformity of the products and services purchased. The warranty has a duration of 24 months starting from the delivery of the goods and the lack of conformity must be communicated to the Owner within 2 months of discovery. To exercise the right to guarantee, the User must send an e-mail to the Owner indicating the order number and an accurate description of the defect (it is advisable to also attach photographic material).

All elements are essential and will be verified by the Owner before responding to the User.

If the lack of conformity of the product is ascertained, the User has the right to obtain, after returning the defective product to the Owner, its repair or replacement. The User also has the right to request from the Owner a reasonable price reduction or the termination of the contract if the repair and replacement are impossible or excessively expensive, the Owner has not repaired or replaced the goods within a reasonable time or the replacement or repair previously carried out has caused considerable inconvenience to the User.

To exercise the warranty right and for further information in this regard, the User is required to contact the Owner.

Refunds not free

The goods must not have been used, tampered with, washed, and must be returned with attached label and original packaging, otherwise the Owner has the right not to accept the return and free refund.

The right of free withdrawal does not apply: to goods made to measure or clearly personalized.

Non-compliant items will not be refunded.

Non-free returns

If the customer decides to:

  • cancel the order before receiving it;
  • refuse the package on arrival despite its good condition;
  • return the products for the third consecutive time and ALZAVOLA believes there is no reason for a defect or incorrect fit, even if the customer has requested a change of goods or a discount voucher

In these cases, ALZAVOLA will charge the customer the return shipping costs and payment fees (€ 18).

EXAMPLE 2.

CUSTOMER ORDER: € 300

REQUEST FOR CANCELLATION OR REFUND THROUGH MONEY RE-CREDIT.

ALZAVOLA RETURNS THE CUSTOMER € 282.

From the third consecutive return from the same customer or sent to the same address, which ALZAVOLA believes without reason, the customer will be charged the return shipping costs (€ 18). Terms of sale

Prices and currency

Published prices and final invoices are in Euros (€). The correct and final price of the items is always the one that appears in the cart, any different display of prices in the product sheet is to be considered an error (sometimes they could be displayed without VAT or with a previous price list), the correct price of the item is always and only the final one that appears in the cart.

Availability of articles

The shop windows on the site reflect the actual availability of the product in color and size. Once the order request has been received, the ALZAVOLA orders department reserves the right to reconfirm the availability of the items purchased, the validity of the transaction by credit card and to check the details of the previous transactions made by the Customer on ALZAVOLA. In the event that the items ordered are not available, or if for some reason the order cannot be processed as requested by the Customer, the ALZAVOLA orders office will promptly notify the Customer.
